How to know if the xbox 360 250g i want to buy is under contract or banned?

Sorry but there is no way to tell if a system is under contract. You could try contacting phone support about it but I'm not sure if they have or could release that info.

If you can connect to Live the console isn't banned, note that it could be modified and later end up banned, but that's going to be very uncommon.

For the contracts it's the console that's under contract, not the account, so it doesn't matter if they remove their account it's still under contract.

To the best of my knowledge there's no way to tell if the console is under contract or not and no way to remove the contract without access to the original Microsoft Account

You need to return that system for a refund because YOU HAVE BEEN SCAMMED. The seller bought the Xbox 360 bundle for $99 and a contract which requires payment of $15 a month for 24 months. The seller had to have known this would happen
because when the console is purchased under one of those plans a contract has to be signed and the console is registered to the seller. If, at any point in those two years the contract is not current (aka you stop paying before the contract is up), the system
will be banned from Xbox Live.

They can't just "delete the contract". It's a legally binding contract that the person electronically signed/agreed to when they purchased said console. Eventually, these consoles are banned if the payment on them is not made. You won't be able to get any
help from Microsoft on this matter because they won't be able to simply change the name on the contract to yours, it's not how these things work, and it would be illegal to do so.

You'll need to go back to the place of purchase and get them to take the console back. Wherever you purchased it from should not be selling contracted Xbox 360's. That's their fault for even accepting a console without looking at it or confirming that it was
under contract.
