    I called xbox support again. Told them about the 95 days. They said they didn't know anything about that, but the guy was actually really cool and took a look at the warranty here on the site.

    He said it looked good and received escalation approval. I just have to wait so many days to hear back from escalation.

    I just don't know how the supervisor I talked to before this didn't know about the warranty...unless their told not to support it until a customer brings it up. The support representative I just talked to didn't know about it and I wonder if they are with
    holding certain information from the support reps. on purpose. You would think that an important part of this process would be informing their support reps. of the warranty.

    Just a tidbit of info about M.S. and the B.B.B.. M.S.isn't accredited with them anymore and their rating is "F". I don't think one more complaint will make a difference.

    Just a "fun" fact for today! Lol.

    This scares me a bit if I ever choose to use their customer support. I just got the X1 and it's my first Xbox ever. It sucks that their support was so bad and I worry because my kids are rough on hardware.

    My son recently broke my 3DS by dropping it. I called Nintendo support and it was out of warranty. Nintendo gave me a waybill on their account so I didn't have to pay for shipping. They couldn't repair it and sent me a brand new handheld back for free. It
    was amazing customer support. Microsoft could learn something.

    @D33dles

    Lol, an 'F.' Well that doesn't surprise me.

    @DJ SANDSTORM407

    Yeah, I think the controllers today are much better than what they used to be. I was just at my friends place, and he has his controller from about May of last year and a new camo controller. They both feel much better than my Day One controller ever did.
    The seems are perfectly aligned, mine were not. The sticks don't pop or click in the slightest, and the plastic material somehow feels a bit nicer.

    @GnollEncampment

    I just recently read the warranty and I don't think you would ever be covered if your kids dropped your controller and broke it. Same if they knocked over you console. It only covers problems that are caused by normal use. The warranty will not cover the
    product if the product your sending in has dents, scratches, and/or other visible unnatural damage.

    Here's the warranty:

    support.xbox.com/.../console-kinect-warranty

    Maybe you can still get some sort of product protection plan. Best Buy has Geek Squad Protection and that might work for your needs. I don't know about other retailers. They were just the first to come to mind. They have an option for gaming consoles, but
    I'm not sure about the extent of their coverage. Wouldn't hurt to ask somebody at a Best Buy for clarification.

    Here's Geek Squad Protection for gaming:

    ***UPDATE***

    The support representative forgot to link my gamertag to my email when escalating the issue, so the escalation was canceled. So I contacted a support representative that I worked with in the past, and she tried to do everything that she could. However, every
    person she talked to said they would no longer support the issue.

    I looked at the warranty again, under disputes. I found that if I take Microsoft to small claims court that they will pay all fees associated with the process as long as the dispute is under $75,000. This will likely be my next course of action. It's the
    law that Microsoft supports their warranty. I don't care if this is just a controller, because companies get away with enough as is. If I take them to court and win, then this would hopefully set a precedent so others wouldn't have to worry about this.

    There is one other thing that I'll try. If that doesn't work, then I'll be taking legal action against Microsoft.

    Good luck with that. Microsoft has some really good lawyers. You loose it would cost way more than $60 plus I doubt you will find anyone willing to take that case.

    Wild, it is nothing to do with X1, it is a warranty/shipping issue with MS. IF support forgot to link his GT to his email, that is a human error, not a console error.....

  11. As most people know I'm not a one of the Microsoft Guardian Squad members, but taking MS to court over a controller is about as smart as calling the cops when someone calls you a name in a party chat. Just don't do it. There has to be a better way. Call
    back and speak to another rep. Keep calling until you get one that will competently deal with your issue.

    I understand where you are coming from, and I do intend to keep calling, but if that doesn't work I will bring this issue to small claims court.

    The last person that I had tackle this issue was probably the most competent person I have spoke to at xbox support. I don't know if there is much else anybody there can do, but I'll keep trying.

    I have one other thing besides xbox support that I'm working on right now.

    I'm just frustrated by what Microsoft is putting me through now, and what they have put me through in the past. I just don't know how I could ever continue to support them.

    So after calling again...

    They told me that there is another version of the warranty that is more detailed and isn't shown on the website (or anywhere is seems). It basically says they can give you a broken controller and you have to deal with it.

    So there is nothing I can do.

    I just read the Warranty for the Xbox One and Accessories. I found this.

    (c) After repair or replacement, Your Xbox One or Accessory will be covered by this warranty for the longer of the remainder of Your original Warranty Period, or 95 days after Microsoft ships it to You. Where required by applicable law, the original Warranty
    Period will be deemed to extend for the period of time equal to the time which Your Xbox One or Accessory was in Microsoft’s possession.

    So they should still honor a repair/replacement because it is still well within that 95 days that Microsoft has shipped the broken controller.

    I'm going call back and try this to see what happens. If nothing, then I will try to get a hold of MajorNelson as I just found the he tends to help in matters like this on reddit. If he can't help, then I will file a complaint with the BBB.

    You need to learn how to use Walmart and stop dealing with Ms customer service. 1. Go to store and buy a new controller and keep receipt. 2. Keep new controller and return old controller and get money back.
