Harrassment and Racist remarks made toward me got me banned?

This is the second time this has happened to this account, but the same person.

All xbox says is "nobody can ban you"

The account [mod removed]

Called me a monkey, trash, garbage, told me to get a life.

He sent me random messages, calling me a monkey, I told him he was racist, and was being reported.

I was immediately comm banned *(the second time this has happened by the same person)*

Xbox Support helps none.

Do I need to reach lawyers for this?

He told me things immediately after the comm ban like "here eat another one" and boom, instant comm ban for nothing. I'm literally the one being harrassed and reporting him constantly for it and it never ends.

I do not know what to do at this point other than try and get this settled with the community.

This is the second time I've been banned for breaking the TOS, which apparently includes being harassed and called a monkey.

Is he a hacker or rouge enforcement agent or what?

I'm so troubled by this because I can't even play with my friends. I get ban after ban added to my account the second the one before it ends.

What do I do?

Unfortunately there's nothing we can do here on the forums as the enforcement team are the only ones who handle suspensions. You would need to go to http://enforcement.xbox.com for
information on why you were suspended and to see about submitting a case review.

If you run into a toxic gamer just mute, block and report them. Never reply to a message. In that case there should be no Actions against yourself.

How did he know I was penalized if they don't share that.

I'm confused how calling someone racist for being racist is against the TOS but being racist and calling me a monkey is not? How is the not a breach of the safety I was guarenteed when I even accepted the terms of conduct.

oh, he violated as well, I never said otherwise. If you have reported him you really have no sure fire way to know if he too was penalized, Microsoft doesn't share enforcement info as a rule.

"But he called me names" is not a valid reason, again that's why it's stressed never to respond, simply report.
