Gamertag on a banned account

As you say they arealso banned on the forums if their account is banned. For them to post on any forum including "my xbox account was suspended", they need to create a new account, and refer to the banned gamertag in their post.

so in this case, their gamertags are not banned, because they can use their gamertags here.

When they ban an account, they ban the account under the current gamertag name. Even if you were able to delete the account, the name XcaliFlawz would still banned. That gamertag is forever forfeit. If they banned your gamertag, then let you have the name
back, what form of punishment is that?

Swapping gamertags ( accounts ) is against the terms of use, not only that, it leaves the people involved open to fraud and all sorts of possible issues. As for your friend with the banned gamertag he can't create a new account with the banned gamertag,
the gamertag is banned end of story.

Once a gamertag is banned you lose everything on that account. The gamertag will no longer be avialable for any account to use.

Hello, apologies, but the information the support agent gave you was wrong. An account that has been banned is completely forfeit, including the Gamertag. You will not be able to get a Gamertag from an account that has been banned.
