Friend is offline but still talking?

I'm a a party with a friend and it says "Last seen: 1 hr ago playing GTA V" or something but he's talking and is in the party. Is this a glitch? If so, how can he fix it? We can't invite him to anything cause it says he's offline

can i still be on xbox live talking to friends and all that ?

and not get banned ?, but i wont activate the code so i wont play

There's no in game chat (design intended), being in party chat puts you in offline mode but you can still play. You can use private chat while playing online, allowing you to talk to one friend.

Does your friend appear offline? The appear offline feature will still increase in day count if they play while appearing offline. If he is not appearing offline, sometimes (very seldom) will the friends list show people with a wrong status, but when
it does it usually updates within a few hours when this issue occurs.

I saw on a youtube video that (if you have a wireless piece) unplug it. start your game, press continue to play offline, (plug in your wireless piece) connect back to xbox live, and you can still talk to your friends and play your previous world. If it's
one of the newer xboxs with the wireless piece built it, someone said to plug an ethernet cable into your computer or laptop and sometimes it'll kick you offline.
