Forza 3: non functional on Auction, and will not give me my Forzathon Achieve or return my ...

1/6/18 I achieved Forzathon Achievement: sell 3 cars on Auction. I listed about a dozen cars for sale, and sold 4. I achieved the Forzathon Achievement. But Microsoft is not allowing me to retrieve me unsold cars, redeem my sales cash, or see that I get
my Forzathon Achievement. Microsoft XBox1 Customer Service will not report this to Technical Service, they will not report this to Playground Games, they will not resolve this problem.

I said, I paid $100 for this game to Microsoft on Xbox1 Marketplace, Microsoft is the Publisher, and it has a relationship with Playground Games. The Common Law of Contracts provides that a product purchased comes with an implied warranty of merchantability,
which means the merchant and Publisher is responsible to the consumer to provide a working product. I pay $10 per month for services to play this game, and solve these problems: they have refused and deny responsibility. Microsoft requires customers to agree
to a long list of agreements, but the Common Law imposes on Microsoft the duty to sell under the duty to provide a merchantable product: defecting and faulty products are not by definition merchantable. Customer Service refers me to Playground games, but
its contracts are with the Publisher, Microsoft and its access to the MS Platform come with duties and obligations to MS to assure merchantability.

I complained that Games' Forzathon induced me to list over a dozen cars from my garage for sale to gain an achievement. On the MS Platform, the game published by MS and developer Playground Games has confiscated my dozen cars worth more than 1 million credits,
and refuses to return to my either the cars or the sale value in points for the 4 cars sold on its platform.

Yesterday the same thing happened on Forza 7 and I was told then that MS was having trouble with its online sales and this includes in game sales and purchases. I spent 250,000 points for the 2015 McClaren Coupe, and MS took the points but did not deliver
the car. I complained: yesterday, it was a problem MS had in its Marketplace. Today, MS denies the same Marketplace issue has anything to do with MS and they refuse to notate or report it to their tech services, and refer me to Playground Games: the problem
is MS Online Marketplace services. I spoke to a service supervisor who refused to report this, or document it, and to resolve it. He referred me to Playground Games: I replied, I purchased this game from you and you run the online Marketplace. I pay a monthly
fee to MS to run a workable or fixable Marketplace. It is the MS Marketplace that glitches, not the Playground Auction site. I pay MS a monthly fee to make this work, not a fee to Playground Games.

Microsoft owes its customers a duty under the Common Law of Contracts to provide Merchantable services or products. Whether or not Playground Games is the developer, MS is the Publisher and I bought the game from the MS digital store. I have no relationship
or contract with Playground Games, although MS does.

Anyone of MS customers can attest to the pages of contract language MS requires us to agree to. Under Common Law, the duty of MS to its customers need not be stated: it is the Common Law of ALL Contracts with respect to the merchant's duty to customers:
its products and services must work, this is the meaning of the Common Law of Contracts. I pay a monthly fee that includes this Common Law guarantee; Microsoft is solely responsible for working systems to fulfill representations of its services, and as Publisher
and Merchant, also its products.

The customer service agent said to me, prove that MS has any duty of changeability to the customer: I said I don't have to this is the Common Law since Roman times, and it is not permitted that MC can contract by dictate to avoid its Common Law duty to customers.

It is the failure of MS's provision of Online Services that will not allow Marketplace Services to return my unsold cars and pay me the sale value of my cars reached at auction, which FORZATHON induced me to attempt to see via that Marketplace Service.
I was induced to use a non working Marketplace Service provided by MS on its platform, which was also known to be malfunctioning yesterday.

MS is quxk to site its contractual rights, and its employees claim ignorance of the Common Law of Contracts: these Common Law Contracts are inferred by centuries of Law and need not appear in contract forms. It is the Common Law, and it cannot be exempted
by Microsoft to cover up its faulty services and defective programs. By Common Law I have a right to rely on the principle that services and products sold by MS are merchantable, which means they work.

I will not sacrifice my achievement that induced me to use a faulty Marketplace system, and sacrifice my dozen cars and sale value for cars sold. What is more the inducement was an Achievement in Forzathon: I earned it, I want it.

By referring me to Playground Games, MS is refusing to acknowledge its duty to provide working systems and as Publisher and store it has a duty to sell a working product. This deflection is meant to get rid of me and put me on a goose chase. The Common
Law of COntracts puts this on MS. My contract of sale and service is with MS, not Playground Games. What is more, Playground Games' contract is with MS, not me. My relationship is with MS and their relationship is with Playground Games via the Common Law
of Agency by virtue of their cooperation in bringing this product to market: I purchased the game and the service upon which it runs from Microsoft, not Playground Games. MS has an Agency Relationship with Playground that has nothing to do with me, their
releationship imposes mutual duties and obligations between themselves, and I may make claim against either under the law of Agency. MS is Estopped by Common Law of Agency from asserting this is Playground Games' problem. MS knows this and so does their
lawyers. They are Estopped by the Common Law of Agency and cannot tell me this is Playgrounds problem, go after them. It is MS' name as Publisher on the game and that means it is not my problem to discern the relationship between the Publisher and the developer.
Microsoft sold the game to me, and sells me access to the online platform, which yesterday had an acknowledged defecting and non working Marketplace. My monthly fee imposes on MS the duty to fix and make right malfunctions that I am induced by reward to use.
I was led into this malfunction, it was put in my path by Microsoft. It is up to Microsoft to make it right. This is the law and it is Common Law, which means it does not need to appear in their pages of agreements and contracts I am forced to agree to.
What is more, it is doubtful that MS can insert language in those agreements to deny the consumer his rights under the Common Law of Contracts and Agency.

I demand a response and my right to my unsold cars and proceeds currently locked up or confiscated illegally in its Marketplace system. I want it and I demand it.

Do Forzathons Repeat?

Forzathons don't repeat, although occasionally the cars given as prizes do repeat (no guarantees of this, though).

oh, it's been a long time since i can nof the Forzathon game in Forza Horizon 3 game, but it does not give me any prizes. make this a step for me because the other cars are not repeatable..
