    Enforcing bans for profanity is going back to the 60's


    HI,

    I've just been banned for three days using any form of communication for calling somebody online a ****.

    In my opinion the enforcement team (the name alone) is a discrimination and should be reviewed by all how this should go any further.

    I believe we all live in a democracy where voting is en essential part of life, in this case there is no vote nor any means to counter your actions.

    If this is the case that freedom of speech is being limited then what is the point of Xbox live comms?

    Surely we are not heading towards a community that is being controlled to an absolute absurdity??

    Don't get me wrong, I'm against hacking, sending nudes and cheating etc, but it is up to the people/gamers to block and mute others and not a team of outsiders that seem to be operation as the judge and executioner without any pardons to be made.

    This is not democracy, this functions as an elite state and I oppose!

    When you signed up for Live, you agreed to abide by the Xbox Live Code of Conduct. You can read this here

    This is by no means a full list, but profanity, and calling people names is against the Code of Conduct. These rules are applicable to everyone who uses the service, regardless of age, gender, race etc. Communications on Xbox Live
    are therefore set to 'E' for everyone, no matter what game you are playing or whom you are playing with.

    Your 'Freedom of Speech' is given to you by your government as a means of democracy to speak out against the government in power, it has no legal basis in a private gaming network which can dictate its own rules. These rules are
    legally binding.

    "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government
    for a redress of grievances".

    The key part is the first part that says "congress shall make no law" and the part about freedom of speech.

    so basically it is saying that congress shall make no law abridging the freedom of speech.

    it says nothing about private companies making rules on their servers that you agreed to abide by when you signed up for the services and agreed to the possible consequences if you broke the rules.

    Profanity is not a ban reason on Xbox Live. They most likely reported you for something else.

    Also, we don't deal with enforcment on her, you will need to go to
    Xbox Enforcement
    to deal with your ban.
