  1. Enforcement


    After finally being able to open a lazy via the X1, what did we find?

    Google search results of this, that or any others listed sites interpretation. And that somehow "backup"s your "claim"?

    How to get not only what want, but interpreted the way you want in the US.

    1, Set up a straw man (bogus) case.

    2, Buy all the corrupt Judges who will rule on said case a Bologna sandwich and have Gates shake there hand.

    3, After filing and winning a bogus appeal. What you wanted from the get go is now..... Drum roll.....

    Case Law.

    Google, who just recently fired a person for just what we are discussing is currently raising the cash to have his day in court. (Takes tons of cash to take on Corporatism)

    Over the coming months or years, lets watch and see how free speech within a 'private business' plays itself out. Enforcement ;)

    if we have no freedom of speech on XBL Wed only be able to talk if and when Microsoft allowed us to. Do members have to ask Microsoft everyday if they can talk on XBL. NO NO NO NO. You wrote what you wrote about freedom speech and it is incorrect. I could
    even message bowski on here or any moderator.

    However the code of conduct outlines how we should behave. It does NOT say it will harshly take away our legal rights and screw what governments say. Think outside the square.

    if we didn't have freedom of speech Wed only be able to say what Microsoft has ordered us to say. It would be like only able to read off strictly from a book and not be able to say stuff in your own words. If we didn't have freedom of speech I would have
    been banned from Xbox. But am I? No! And I've had Xbox for 7 years. The code of conduct outlines how we should behave. Not take away our freedom of speech and our rights.

    You may find these links interesting. Microsoft isn't a heartless corporation. Bad/unfair customer service to a corporation as big as Microsoft would hurt their reputation.

    Microsoft does not say that if you use Xbox, that your right to free speech doesn't apply, in their terms of service nor Code of Conduct.

    Free speech is part of the bill of rights. However - the Code of Conduct does list rules which list specific behaviors required.

    ^ This could still be applicable on the forums too. Because this site is the official website of Xbox. And we use our Xbox/Microsoft account to participate on it.

    While yes we are using a service which we agreed to with Xbox, it does not negate our legal rights if our country law doesn't allow it to. Yes people if you visit their home can kick you out if they don't like what you say. But if they kick out innocent
    people who don't break the law in their country and who follow the code of conduct, that makes the business an unfair business and then you end up with complaints which goes to the reputation of the business. And that's not something Xbox is about. People
    may think it to be, but it's understanding the behavior (likely bad) that lead to it.

    People can have free speech and still control their tongue (no racist, no swearing, no name calling, no sexist). Though more people are bound to give in to such language at some point(s).

    Microsoft only gives a 90 day warranty for the Xbox One Elite Controller. However in NZ/Australia/UK, we get 12 months because a 3 month warranty on an expensive accessory, is not a reasonable warranty length. Many consumer items
    get at least 12 month warranty. If you read their service agreement in sections 8 and 9, the contract cannot negate laws from members own country if they live outside the US. My point of this paragraph? Legal rights have at least some influence.

    Again, if your right to free speech does not apply to Xbox Live, why does Microsoft run this forum which runs on Xbox Live/Microsoft servers? Why does no one have to ask permission from Microsoft every day to speak, message and socialize on Xbox Live without
    a script which needs approving by Microsoft? This is freedom of speech. Although it needs to be done in a reasonable manner. If it weren't, I would have been banned from XBL years ago, and have had Xbox for 7 years. There would be pretty much no under 18 year
    olds or young adults using Xbox Live. As we pretty much all would rather find some other hobby where we could reasonable or what have you, exercise our rights. Though while using a service, you would want to be respectful and courteous. But you certainly don't
    always have to not allow freedom of speech.

    I think the majority get banned for modded consoles, bad language (swearing, name calling, gamer tag shaming (some regulars do it on here), sexist, racist, etc). This is behavior.

    If you can follow the Code of Conduct, you should be fine. Most of it is common sense. They could kick me out the door. But the company is structured and has high standards in handling with customers and as an important company, their culture and ethics
    in how they treat customers is pretty high. Yes we make mistakes. Yes it's their service. Yes they will make mistakes too. But what's the point of running Xbox Live when you make that statement about no right of speech. Xbox is for everyone, no matter what
    age or country or your socio status thingy. It creates a diverse culture and atmosphere of encouragement, play, etc. Yes some businesses can be strict and more heartless. But Microsoft has standards in place to discourage any staff abusing and heartlessly
    judging members. Most people may just need educating to help correct behavior. I rest my input in this thread.

    There is a difference between Hate Speech and Free Speech.

    Tell me, does XBL require everyone to have scripts from Microsoft or permission from Microsoft on every word, everything, we can chat say write send and receive, on XBL? Lets think about that.......................................

    ....The answer in short is no. That, is a form of free speech. Certain people say it does NOT apply to Xbox Live. Then, wait.... why don't we need permission for that? Cause that's free speech right there!

    I've been doing it since 2011 and I'm still enjoying it. I'm nice when you get to know me. My friends say I never/hardly say any bad words. Microsoft have offices in NZ and Australia. You know what that means. They're subject to the jurisdictions of those
    countries too. I read an article from this year how my govt audited Microsoft NZ for taxes (which they pay) Laws vary from country to country. I have no intention of prosecuting them and it wouldn't be an easy process for an individual alone. They're a good
    company. And I know not everyone is going to agree with me. They allow free speech to a certain degree. If it's all nice stuff, it should be fine. And to me that's what the COC is about. Nice stuff and exercising good behavior. Which surprisingly a lot of
    people struggle with from rarely, sometimes, usually, more often, etc. Google definitions of words mentioned in the COC may shed a lot more light on why people get the b word. Context matters, as quoted in the enforcement site.

    I recommend reading their corporate responsibility official website. Read this quote:

    Theists for example often get into trouble for simply saying 'bless you brother,' while trying to avoid a confrontation while people with Gastric problems may get ruffed up and jailed for 'gasing an officer.' Point is that in this intolerant age, regardless
    of law, there is no such thing as freedoms nor rights.

    If we are that intolerant of our fellow man in public, how much moreso are we online?

    the current enforcement on Xbox live is a complete joke people can spam reports on you and then you get banned for two weeks at a time. Even if you message someone without any derogatory language if enough people report u there is a very strong chance u
    will be banned. Of course the trolls,cheats,and players that's leave games early during ranked play usually get away without any punishment.

    always occur as a result of a specific Code of Conduct violation.

    To get an enforcement action you must have broke the tos/coc. Go to Enforcement.xbox.com and sign in and apply for a case review

    You are responsible for your account & everything that happens on it.

    Even if you filed for a case review & the decision was overturned (highly unlikely) it wont be done in time for you to stream.

    Lesson to learn: Don't let other people use your account.

    Try not to rise to baited messages, REPORT, MUTE, BLOCK and move on. These steps will ensure you stay free of suspensions and trolls hate not getting a response.

    You can file to have your case reviewed by the enforcement team. That way they can hear your side of the story. If you are interested in doing this Here is how to do it.

    You will need to go to http://enforcement.xbox.com sign in and click the orange hammer in the top left of the site.This will take you to your enforcement history page. Find the current enforcement effecting your
    account. Next to it on the right you should see a link that say submit a case review. Click on that and follow the prompts.
