Enforcement

I have been banned for "anti-semitic" jokes I sent to my friend after someone reported me and the enforcement team looked at my messages. The duration is 14 day's and I filed a Case Review and they Upheld the Decision. It say's nowhere in the Term's Of Service
you cannot send jokes. I know that it say's no threats but I never threatened anyone in particular and "hate speech" is protected under the U.S. Constitution as freedom of speech is the first Constitutional right. We both live in America and therefore are
protected by the law's that govern the country. I'd also like to say that I never had the jokes reported, it was most likely something else I said to someone that wouldn't get me banned like gg or XD, it could have been camper, but I've never been banned for
saying "camper".

One thing that we're maybe forgetting...

Why do you think the xbox one has mandatory checks on games within 24hours and Sony doesn't? It's blatantly obvious Sony won't enforce the same level DRM as the xbox one.

 

Jokes are not a problem. However, if something said in the joke violates the code of conduct, you can be suspended. Freedom of speech does not apply since Microsoft is not part of the government.

 

Microsoft still has given emails to the F.B.I. before, so, therefore, they are allied with the U.S. government. You can't do something and say another.

 

First lets look at the First amendment:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government
for a redress of grievances."

Basically in laymens terms it says that Congress shall pass no law preventing the freedom of speech.

Think of it this way Microsoft wants Live to be E for everyone. so lets look at a real world scenario with a business that is supposed to be E for everyone Chuck E Cheese

Say you and a buddy are sitting inside the business and are talking about anti semetic jokes and somebody is not happy about it and goes to the management the management of the establishment has the right to
ask you to leave and if you dont can call the police at that point because you would be trespassing.

 

That's like saying you can't bear arm's from a private company because the law only refers 's to muskets.

If this was brought to the attention of the Supreme Court and Microsoft was founded in the U.S. (which it was) then they would rule in the favor of the Constitution, of course, other countries that use propaganda or fascism and have no freedom of speech
would not have to follow suit.
