First Amendment

Sixth Amendment

Seventh Amendment

law.

Eighth Amendment

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Ninth Amendment

Tenth Amendment

in about this i will call them today about microsoft to see what there going to do if this dose not get fixed i will open a law sute. we should talk how we want i play a 17 and up games only and they cuss but when i say the F word i get reported and banned.
but thy say some trash talk is alloed ok. this is the worst gameing company i have seen. thy will not banned hacker but thy banned players that cuss.

It's difficult to see the point or issue you are trying to address in the wall of text you posted without separation of applicable paragraphs or sections.

You may do whatever you feel is required however it is inappropriate to post threats of legal action in reprisal for what appears to be a violation of the Microsoft Terms of Service regarding your use of the Xbox Live features.

Hi. While I understand you are upset, microsoft is a private company and thereby allowed to set whatever rules they wish for there terms of service. When you opened an account you agreed to abide by those conditions. Therefore they breach nothing if you
have broken them and they enact a punishment that was notified as a consequence upon you opening an account.

You are of course able to submit a case review if you feel you have not broken your contract with them Enforcement however you have admitted you broke the terms and conditions
so I wouldn't imagine they will be able to help you.

 

Retaliation is never okay, just report and block. And the 1A is wildly misunderstood.

 

OP, please edit your thread to remove all account and ToS sensitive information, and format in a way that can be read by viewers so that a discussion can take place.

 

Using freedom of speach is an incorrect line of defense. The first amendment opens with Congress shall make no laws. The United States constitution was written to protect the people from the Government. Microsoft have the right to make rules
for their services, which are the same rules that Sony use and many other online communities.

Feel free to go seek legal advice but you may find that you have no legal complaint to make.

Enforcement works on a reporting system. If you feel that a player has violated the code of conduct, then you can use the built in report feature. You should never confront these people, as you may well be reported too. Report, mute, block, do not respond.

 

The U.S 1st Amendment doesn't count here because Xbox Live is a private network, not an instrument of the government.

It's true that Ambassadors are not Microsoft employees - we are just fellow gamers - but it's also true that what they said is correct. The bill of Rights only covers what government can and cannot do, not private enterprise.
