    To whom it may concern,

    Hello my name is Dash X73. Today I would like to discuss the sole vocal statement I made during the black ops 3 beta in 2015 while streaming on the twitch.tv service while playing on Xbox Live, that lead to my permenant suspension from Xbox Live.

    During my Twitch Stream I vocally stated over the broadcast, that I would offer compensation to an individual that would go to pax and punch steinkin in the face with brass knuckles made out of the xbox ambassador pins he was handing out." I said in a response
    to an event that happened earlier, It was meant to be a joke and a parody, the compensation was so large that It was implied that It could never be given, but someone in the chat reported the statement. Which Lead to Xbox Enforcment Team Permenantly Banning
    me from Xbox Live until 9/9/9999. I also lost all the funds and digital content on my account, and can no longer acess them offline, or on another account, because I did not set my xbox as home. Some lucky indivudal that had my old Xbox that I returned to
    the store because of a broken controller will turn it on to find the ready to install section full of my games.

    Some background about me and my culture. I grew up with watching westerns, and playing hockey. Fist fights were a normal way to settle disputes, among relatives, friends and strangers. We didn't keep punching once our opponent hit the ground, and the fights
    were never meant to cause permanent injury or **** the opponent. I have had a black eye, fat lip, broken nose for at least every year of my life. I still have bounderies, and morals, I was taught to never hit a girl, and to punch first if I'm going to have
    to fight. Even with how violent our games are today where we chainsaw others in half, or run them over with cars, or blow them up with bazookas, I think my vocal statement was taken from an overly sensitive viewpoint especially because it was never acted out
    on. What would have happened if I went myself and actually punched him in the face...

    Regardless, Because of the Diversity of the Xbox Live Community, there will always be something that is offensive to one but not to another. In most phyical contact sports, fighting still occurs, and these players are not banned from the sport. In sports
    like hockey, boxing, or UFC it's encouraged. My intentions were never to kill the indivudal, in fact I probably would have shaked his hand after. I feel that the majority of community members are way to sensitve when it comes to their comfort and displeasure
    of others. I have heard and seen far worse things on the xbox network over my many years of using the service. I was an original xbox owner, and was excited to play on Xbox live in its orignal release. The way I have acted had not changed, the only difference
    is this time more people heard me say it. My channel was even listed for a mature audience but because of the way the xbox dashboard worked it still featured my channel on the dashboard to anyone who used the xbox live service. Twitch didn't care what I said,
    even tho it was broadcast on their service, I was simply playing my xbox when I said it. It was not even spoken in Game chat, or through the xbox live party system. It was not said directly via voice message to the indivudal. It was said over twitch broadcast
    only. It is not my fault that Xbox hosted my channel on thier dashboard for anyone to see. It made me regret to play the free to play beta on my xbox, I simply should have played on another platform.

    I did not even at one time directly message the individual that was later referred to as the Microsoft Employee.I didn't even know the said person was a microsoft employee. I was venting my emotional upset, yes what I did was wrong, but the way it was
    handled was too severe. I decided the only way I can prevent future violations is to not use the service. The Ideology behind the Enforcement Teams Action seems to be very extreme during certain situations, but racism and other culture harrasment is taken
    less seriously than my inccident. I tried to appeal the enforcment teams decision, but I orignally used the Appeal button on enforcment.xbox.com to find out why I was banned to begin with. It happened suprising and it did not tell me why I was banned in the
    original email I recieved, it simply stated I violated the code of conduct. I just wanted to discuss how other members of xbox or microsoft employees feel regarding this case. I have since not used the service since 2015 but still wanted to bring about conversation
    in regards to the events that happened the policy around it. I tried to take this to reddit hoping it would gain some light and an executive or managment employee of microsoft but most users sent me hate mail suggesting that I got what I deserved and Im just
    crying to get my account back. Regardless, I will not be retuning to xbox, perhaps this can be an example for others on how to avoid enforcment taken against them, or used as a case decision about the policies surrounding online gaming and the vocal communication
    on xbox live.

    Enforcement on Xbox

    Today i received an email that my account from permanently banned. I went onto the link that they posted and it turns out i got banned for soliciting etc. I submitted a case review and went looking for more information. Most suspensions/bans are 1,7, or 14 days and my type of suspension followed under that list but then it said something about if the action was egregious or excessive bans, it could lead to a permanent one. In my case i tried selling my og gamertag, the guy messaged me about it, i told him how much and what payment. He declined, i said ok, and then we didn't message again AND no personal info was transferred, so in my defense it was not egregious. I have only had 2 ENFORCEMENTS, a good reputation, and no consecutive or reappearing issues. I do not think that deserves a permanent ban from all my years of gaming and achievement i have earned. There is clearly a flaw in the system.

    Sorry, but the enforcement team does not use these forums. They can only be reached via the case review option on https://enforcement.xbox.com.

    As for what you did, per your own words you threatened physical harm/encouraged physical violence toward another user (and very specifically) while on the Xbox service which is clearly stated in the code of conduct (Microsoft’s Code of Conduct Explained for Xbox Live Customers)
    as something not to do.

    Joking or not, you did it, and during a broadcast. In this day and age with social media, everyone has to be careful what is said in public. Just look at any of the stories in "The Internet Ruined My Life" TV Show. Best thing to do, learn from the mistake
    (which it seems as though you have) and help teach others to not make the same mistake.

    Remove permanent ban from my console

    Only the enforcement team handles bans/suspensions and the only way to reach them is by filing for a case review.

    Console bans are not eligible for case review. Permanent console bans are just that. Permanent.

    If the console ban is permanent then your only option to continue playing online is to get a new console. Permanent console bans are just that. Permanent.

    I was console banned can it be uplifted or no?

    If is a console ban and not just a console priveledge suspension then those are permanent and never reversed.

    The enforcement team are the only ones that has information on/deals with bans. The only way to reach them is by filing for a case review. Console bans are not eligible for case review.
