    so I bought a new Xbox 360 and I wan to download my account on my new360 but I keep on getting a message " sorry, Xbox live profiles can't be downloaded right now, try again later.

    Xbox share? Hate to ask again.

    You can download the game from your account, once his account has your xbox set to "home"

    It's the same as it's always been. They are on the console so will stay on the console for all accounts. If however they get deleted from the console only your account can download them again. So yes, the "purchase" is tied to your account but anybody can play them on the first console they were downloaded to.
