Have you checked your Xbox settings?

Settings > Privacy & online safety > Xbox Live privacy, There is a setting for Clubs

If that still does not work, check your account privacy settings here: Microsoft Account Privacy Settings

Look for the Xbox section, and make sure that your account does not have Groups set to Block.

No one here can answer that 100% although privacy settings wouldn't affect anything regarding enforcement.

It wouldn't really matter. If anything is done on Live that violates the code of conduct, whether it's in a private chat or not, the enforcement team can still take action.

 

so if someone can't hear me and they report me for communication i still would get in trouble?

 

Yes. The enforcement team will still investigate and if they determine you have done something to violate the terms, they will take action.
