Disgusted !

My son gets an email today stating that his account/gamer tag has been perminently banned due to the use of illegal software use. I come home from work to find my console (but not my gamer tag has been banned). And his console still works on live with my
tag. But my console is banned !. Now I know for a fact that both consoles are not modified in any way. I've even offered to send my slim out to be inspected for the security seals to be checked. All the telephone support would say is that I have to post in
this forum. (which I have done but waiting for it to be approved). What I can't understand is 1. How can someone supposed to play illegal copies of games on non modded consoles. 2. Why ban a non modded console that is 99% of the time on live with my gamer
tag. And not his own.

As said neither console is modded in anyway!

Starting to think the Xbox one I brought before Christmas was a bad idea. And should sell up and move to Sony

I have only seen out of balance team numbers cuase this. You can quit or slow your roll. Slowing your roll gives you a chance to push them back to their original spawn point allowing you to bust out.

I had a bad game the other night on atacama,2 choppers a tank and a load of dudes,boxed like 5 of us in cos everyone else left.i took the tank out with a tracer and CG but when i died and came back in it was just SPAWN,DIE,SPAWN,DIE,SPAWN,DIE til i got mad
and left.I posted about it after but i think it got took off!I was'nt a happy bunny!

 

The Enforcement team does not ban consoles or Gamertags with out investigating the issue or violation first. They only ban if there is proof of any Terms of Use or Code of Conduct violations. If we are talking about playing illegal copies of games then we
would refer to column F. in the Code of Conduct stating:

"F. Cheating & Tampering

Do not cheat in a game unless the developer has deliberately enabled cheats.

Do not use unauthorized hardware or modifications.

Do not exploit game vulnerabilities or glitches.

Do not make unauthorized modifications to your account profile or its contents, including but not limited to tenure, Avatar, saved games, Gamerscore, or achievements.

Do not intentionally play with someone who is using unauthorized software or methods.

Do not play any illegitimately obtained software or pirated games.

Do not take any action to cause degradation of service for Microsoft or other users, including but not limited to network interference or manipulation.

Do not play a game before it has been authorized for play on the service."

The console may not have been physically modified but the files or content may have been modified. A blue skinned avatar for example.

 

While I whole heartedly agree anyone that cheats etc should be banned. does that give Microsoft the right to randomly ban a console?.

He is 19yrs old and an adult. So should be able to know right from wrong.

Yet his gamer tag gets banned but his fat console is fine on live.

But My 14 month console downstairs gets banned for something that was out of my control. If and I say if. (because he won`t admit he has done nothing wrong) he did modify his gamer tag in anyway, and it had been flagged. then. why am I being persecuted for
something I had no control of.

After all didn't Microsoft say that you could move your account by usb stick from your console to another (i.e. friends etc.) so potentially any console that he had used his gamer tag on could be banned, if he had modified his gamer tag!.

I`m sorry but if he did do something wrong then he deserves the ban but why should I loose my console . Or for that matter anyone else that came into contact with a flagged gamer tag?.

 

Simply having a gamertag that warrants a ban on a console will not get a console banned. Consoles are only banned if there has been some sort of tampering/modding done with the console or can also be banned if there has been multiple infractions on the same
console.

 

I believe there is a three strikes rule (3 Accounts banned on a console = console ban) or just a complete ban on the console depending on severity of the offense. Also, if his account was on 3 consoles, the only one console banned would be the one on which
the modding was going on.Your son, or someone in possession of the account, violated the Terms of service in a way that resulted in a console ban. You agreed to the Terms, so you can be held liable.Microsoft does multiple investigations, console bans are not
something just thrown left or right.

That's exactly what I mean. My console is not modded in anyway what so ever will even send it off to be checked out. Yet if he has done something wrong. It's me that's lost out.

Sounds like your son owes you a new console. In fact what you should do is take his console until he does. Perhaps that will motivate him to tell the truth about what happened.

 

In response to Microsoft having the right to ban a console without warning, notice or explanation, yes, they do, as stated in the CoC which I linked to you in an earlier post. It states at the bottom:

"MICROSOFT IS NOT OBLIGATED TO SEND YOU A WARNING BEFORE THESE ACTIONS OCCUR. If your account is suspended while you are participating in a tournament or competition, Microsoft assumes no liability in the loss of any potential prizes or recognition related
to the tournament or competition. Microsoft is not obligated to monitor every post or activity, but has the right to remove any post or take action against any user.

Microsoft reserves the right to remove at any time, without notice, any user-created content, account, or device from the Services for actions determined to be in violation of this Code of Conduct or Terms of Use. Microsoft also reserves the right to immediately
terminate or suspend a user for violations.

It`s one thing to ban a gamer tag but if that account was used on friends consoles aswell then they could also have their consoles banned!

at work I have no control what he is doing with his gamer tag on my console why he is downstairs. Unless I take everything of mine with me to work.

And to have no course of even remotely trying to get it unbanned is even worse.

And all this on top of Microsoft taking money off an expired credit card of mine 2 months ago.

I think I`ve just about had enough of this establishment!.

I hear a PS4 calling.

Good job Microsoft don`t do car insurance.

Otherwise if your car gets stolen and the thief mows down a pedestrian.

They would hold the policy holder responsible.

 

There's no real way to determine which account "owns" a console, you could look at the one that's on it the most, but there's no guarantee that it didn't just change hands, or that the account that's on it the most isn't a non-owner that happens to use it
more than the owner.

They ban the console that they determine to have breached the Terms, Sony will likely do it the same way.

That is the risk everyone takes when they allow friends/family to use their console. That is also why MS recommends they be monitored by the owner.

You don't need a USB to move an account from one console to another. All you need to do is recover it onto one. MS doesn't care who owns the console, what they care about is if the person using it is following the rules they agreed
to obey while using their service.

Once a console is banned is not reversed. There have been an extreme few cases where they have undone a ban but that is like seeing Haley's Comet.

That would have been YOUR fault. It is our responsibility to keep our payment information up to date. MS has absolutely no way of knowing when a credit card is going to expire.
