decisions based on lack of evidence

Ok so in recollection of my last post there was an update from XBLPET. my case has been moved from under review to upheld meaning there is no conclusive evidence from me or the trolls who started this despite me admitting to minor profanity. the only people
who could tip the scale are only available through xbox which means i cant ask them to to share there experience of what happened due to the auto-suspension that was placed on me. Does this not work like any courtroom? if there is no evidence or lack of it
to prove one side or the other despite a confession that the suspension should be immediately dismissed or post-pone it until sufficient evidence is provided to XBLPET? Apparently me telling them i used profanity is not hard evidence for whatever reason.

I'm comfortable with the answers I've received to my questions so I will drop the subject and we can all move on.

As of this moment MS hasn't responded to my inquires and they are the only ones that can clarify this any further. Best any of us can do is take the information we have available to us and make a decision based on the evidence.

If you have done nothing wrong nothing will happen.

Microsoft ban people based on evidence, not what some kid on call of duty thinks of you.

 

If you used profanity and you get reported, you get suspended. It is not an automated system. When reported, data is sent to the enforcement team, they review it and take necessary action.

 

but njal upheld status means there was no sufficient evidence to prove their side of the story or mine.

 

You need to understand what upheld means. It means they have upheld your suspension bassed on the evidence (profanity that you already said you used) and the suspension stands.

 

thats not what im being told by a vast majority of others i spoke too about this. i have 2 witnesses as evidence to prove my side of the story but cant get this to the agent who reviewed my case. i wont stop fighting this njal. i wont roll over like that.
people use profanity every second of the day on xbox and 90% never get reported as people simply dont care. if i did something far worse than one bad word i wounldt be so outspoken about it. this is over excessive punishment for a small thing which borderlines
abuse of power of their end.

 

I know you're upset, but it is easier to just forget about it, learn from it and move on. There is nothing you can do I'm afraid.

 

I am not saying profanity isn't used, many go unreported. Unfortunately you got reported, you can fight but it won't get you anywhere, as the Code of Conduct clearly states about the use of profanity.

Context is a thing too, you took the steps to open a message and aim an [Mod Removed: Profanity] at another gamer. Not just an [Mod Removed: Profanity] in a in a situation like ' oh dear I have just been killed' reaction. Your use was aggressive and directed
at an individual/s which is a nailed on violation of Code of Conduct.

I do understand, I fell foul of it myself several years ago. I learned from it and moved on.

 

that [Mod Removed: Profanity] was used because our group was bein harassed by higher level players who wouldnt leave us be. thats not simply getting killed. we ran and they followed us they made their intent known.

EDIT: OK HOW WAS THAT PROFANITY? nobody was using it in that manor whatsoever it was being used in context of the original post. and its not actually profanity unless you spell the word out typing

If you read your own posts its mod edited heavily due to violations of the terms of use and forum rules

Attacking another player continoously is a clear violation and considered harassment

You have to remember violations can slso been from weeks ago

So context wont count in most cases as noome will tell you which report or who reporred you

Hence why the majority of people who pretend innocence fail

Because they dont get that its never immediate unless extreme case

Or they pretend to understand the freedom of speech

 

Wouldn't mind I wrote F followed by bomb and got moderated. Which now makes me appear to have used profanity. That is over velous moderation.

 

If you break the code of conduct on xbox then you get suspended maybe you think twice next time

 

Any foul language will get you banned if you're reported.
