Controller Issues

I had just recently had these issues w/ my controller:

1) when i keep the x pressed, it no longer turns on the console.

2) when i go to turn the console off by holding down the x, i choose shutdown, the console turns off but the controller stays on.

i had resynced this thing numerous times and also did a hard shutdown by unplugging the power supply. I redid the update to controller, but it told me that it is already updated. Anybody have any resolutions to this or do i need to buy another controller?

Bah. That thing sucks. I think that tripled my amount of all time shotgun kills.

do a repair service request it should still be under warrenty
