    how does the game control the graphics card?

    a driver deals with very low level resources allocation and allows easier access to the programmer. Ea did not design the hardware, how would they effectively use it safely without a driver?

    this is all part of the SDK and tools,

    that said unlike a pc the developer can choose to forgo these and code to metal if they wish, right down to assembly language.

    Device bans are not something that the
    Xbox Live Enforcement     team hands out lightly. There is currently no way to submit a case review for device bans and the ban stays with the console, regardless of who incurred the ban. For any further information regarding actions taken by the Xbox Live
    Enforcement team, please check out the above link.

    Unfortunately once a console is banned, it cannot be unbanned.

    Policy Enforcment is handled by the Enforcement team, and they only respond to questions in their forum section here:

    You can ask them there, but they will tell you the same thing.
