Console banned hardware question

My account or xbox wasn't banned, i don't do anything but play games and watch netflix on my console but my warranty recently ran out and now my console doesn't scan games anymore.(i can still play downloaded games) my younger brother(13) on the other hand,
has a xbox still working but he got console banned.

my mom completely banned him from using the computer and consoles online but i was wondering if i could use his xbox 360 with my perfectly good account and not get banned because of him... don't really wanna buy an entire new xbox when theres a perfectly
fine one in a box in the family closet.

he's 13 and im 22 so i doubt i'll be doing anything he did to get banned but, i dont wanna risk logging on a banned console and get banned assuming thats how these bans work.

Banning material

Okay, ya boy got banned for "cheating." Not a big deal; I was only banned for one day. Anyway, I have a question about hardware that can get you banned (I don't use anything modded). Can a XIM4 get you banned?

Banned Console Questions

Microsoft do not un-ban previously banned consoles as they are permanent. They do not ban people's consoles/accounts lightly, they do so after several investigations.

The most common reason for a banned console is modifying it, but there are other reasons such as marketplace theft.

You might want to post in section 14 in order to get an official answer.

If it's just his account that's banned then you should be fine unless he did something to the console. If the console is banned, you won't be able to sign on.

you wont get any officialy supported answer to that question here as opening your console and changing hardware (even of the same kind) is a violation to the terms of use and can result in a console ban.

Hardware modifications are a console ban, modding it for cheats and/or infections can become a console ban. It's generally the most serious or repeated offences that cause a console ban.

I’m understand that but a permanent ban and then my console be hardware banned for a month for it is a bit much
