Communication Ban

I got banned from communications for calling (what I now know) a kid a "douchebag".

We were playing Friday the 13th. After he was killed he quit the game. This game does not have dedicated servers and this player was the host. After he quit, the game ended for all of us. I sent him a message calling him a douchebag. He then replied he reported
me to which I said I reported him for quitting early. I also told him that I did not curse nor harass him so his report would not matter. We actually chatted for a bit and he apologised for quitting and we added each other as friends. I wake up the next day
to an email saying I've been banned from communications for seven days.

Now, in what world does the use of "douchebag" warrant a ban on communicating with others on an online platform? I've had Xbox Live for 12 years and have never once had an issue until now. The Code of Conduct is a bit vague on the issue. The word "douchebag"
is not profanity, hate speech, sexual in nature or racist. It's certainly not harassment. The only umbrella in which I can see this applying is perhaps in the "speech used to harm" but that is equivalent to calling someone a loser (literally).

I sent this for review, but it was denied and upheld. Again, for calling someone a douchebag. Microsoft has done a good job keeping the online community safe for kids, but they need to do better. Perhaps allowing kids to have a specific type of age restricted
profile that does not allow communication from random players who are not friends. What is this kid going to do in real life when someone calls them a douchebag or worse? There's no report button in real life. Adults need to be able to talk to each other in
a real way (trash talking is officially dead now). I mean the game is rated M for Mature in the first place.

Being banned twice

Is one a communications ban and one an account ban? Or are they both communications bans?

 

I got a communication ban, while I was already banned from communications.

I apparently have received a communication ban on my account, while I was currently doing time for another communication ban. How could I have received another communication ban while I was currently communication banned?

 

Ratings are only for the games themselves. Everything else on Live has to remain E for everyone. That word is still not appropriate to call anyone so it is not allowed.

 

Microsoft has the means for child accounts to be restricted from receiving friend requests and/or chatting with people not in the friends list but that is up to the parents of the child to put those restrictions on the account.

M rating in games are only for the campaign portion of the game the online portion of games are not rated. And the ratings are only for purchasing the game an M rated game can only be purchased by an adult by law. Once the game is purchased there is no way
for MS to control who plays the game.

In regards to actions taken by our Enforcement team, there is nothing we Ambassadors can do, but advise on the situation. If you instigate the aggression, by sending a message with something offensive, effectively over something petty, there are going to
be repercussions. Hopefully you can learn from your mistakes, so this does not happen again.

Yeah, all I can suggest is trying to not use language that could be considered offensive.
