COC - Xbox Live Contract - Is Illegal - Scammed Out Of £439

On Tuesday my Xbox Live account was permanently banned for no reason. However, being a loyal Microsoft customer for over 3 years, I proceeded to create a new account. I purchased £15 Xbox Live Play & 3 Mouths Xbox Live Gold at a cost of £29.99. I did
so because of licence Transferring which states to re-download content from the CONSOLE system and does NOT mention accounts issues. However I was not allowed to access my account management on my banned account, where licence transferring is located. I then
decided to try transferring from my new account where it states CONSOLE CONTENT and thought this would allow me to download everything again, however it did not.

Over 3 years I have purchased DLC worth £339, and am not not able to accesses it, even know this is vie a 3rd party and not related to Microsoft. This appears to be a money making strategy by Microsoft . However if I put this situation into a different
context, the SCAM as well as the poor treatment of Microsoft customers is more apparent.

If I was to join a gym (Xbox Live Gold) Then i bought a pair of shoes for the gym (games) then because I`m exceptionally better than other people(players), I am reported by childish members (Xbox Live Community) multiply times, for no other reason apart
from they want me removed from the gym (community) because I embarrass them . The gym then proceeds to BAN me, however this does NOT entitle them to the ownership of my shoes ( DLC) If they would not allow me to access my shoes it would be a criminal offence.
A contract does NOT remove CRIMINAL offences from the court of order and does NOT rule out that a CRIMINAL offence has been committed. I can not give a person a contract that states I can kill them, which I do. Then expect it to not be a criminal act because
of this. Microsoft is braking the law to millions of its customers and has produced an illegal contract.

The excuse can be used that we signed that contract.. However a document of the contract is not produced upon purchase. Forcing the customer to agree to the contract or lose the money paid for the console. This also falls into the Black Mail category and
    once again is illegal.

I kindly demand a full refund, as the amount stands of my consoles purchase history or for my Delta Marine 14 account to be un-banned immediately and a refund of £29.99 to this new accounts expenses as stated above, which will no longer be valid.

    :)

    Hi there,

If you have any questions about the enforcement action taken against your account, you need to post in the Enforcement section of the forums here:

    forums.xbox.com/.../41.aspx

Only the Enforcement team can answer questions related to enforcement actions. Keep in mind it's a moderatred forum so posts won't show up right away.

For the contract document that you say you were never provided, in order to creat an account, you have to agree to the Code of Conduct and Terms of Use. You had to select the box that said you read and agreed to it. If you failed to read the documents provided
before signing, it is not Microsoft's fault.

As for a refund of the purchases made on the suspended account, per the Terms of Use:

3.1. What happens if I do not abide by this Agreement? If you violate this Agreement, we may take action against you including (without limitation) removing your content from the Services, suspending or cancelling your access to the Services, asking you
to refrain from certain activities, blocking your console or device from accessing the Services, and/or referring such activity to appropriate authorities. In the event we take action against you for a violation of this Agreement, we may permanently delete,
and you may permanently lose, some or all of the information or content associated with your Microsoft account and/or we may cancel your Services in their entirety. Content that is deleted may be irretrievable.

    Wish I had more.

Have you ever read the Code of Conduct? At the bottom it clearly states you lose access to content upon a permanent ban.

Your gym analogy does not apply to xbox live in any way. You dont own anything you bought on Xbox Live. You merely own a license to use the content.

Also everyone on Xbox Live could report you, but it wouldnt matter unless you actually did something wrong.

And all purchases are final that are made on the marketplace unless the content does not work.

  5. Hi there OP,

Making duplicate posts about the same topic, and after verifing an answer of one of the respondants in your earlier post isn't going to help your cause. Onyx62is responded to you here:

The Xbox Live enforcement team (PET) now has a website that explains issues such as you have.

    http://enforcement.xbox.com/

On the site the Code of Conduct lists reasons for being banned.

    www.xbox.com/.../CodeOfConduct

Being banned means that you forfeit any right to content on that account.

UPON RECEIVING A PERMANENT SUSPENSION, ALL CONTENT LICENSES, GOLD MEMBERSHIP TIME, AND MICROSOFT ACCOUNT BALANCE ASSOCIATED WITH THE SUSPENDED ACCOUNT ARE FORFEITED.

The PET do not ban accounts arbitrarily for any reason. The investigate any complaint filed against another player. However, if you feel that your ban was made in error you should post in the Suspensions Forums and they can answer your question there.
