Thank you for posting here on the Xbox forums. Are you saying that you got charged for Games with Gold title? In that case, you would need to request a refund. Check out this link :

If the link does not work in your region, then you must contact a live agent
to resolve the issue.

You should not have tried to buy the game if the subscription was not already active, so you avoid problems, but you can still get a refund if you talk to Xbox support.
