Can't set home xbox

Your analogy is incorrect and doesn't pertain to the subject matter we have been discussing here. If wish to use a retail analogy here, the correct one would involve your friend giving you the item(s) that he had already legally purchased and owns. As in,
he purchases a disc version of the game and willingly lends/gives it to you. Your example would be theft because the items in question were not legally purchased by anyone beforehand. When you purchase a digital game from the Xbox Store, you're paying for
2 copies of it. Moreover, you're applying the "Home Xbox" concept to a retail store as opposed to a product that you purchased and legally own, in this case being your Xbox One console. A feature of the console is not a loophole, and the game developers/publishers
aren't losing money from this because of the prominence of the used game market.

Again, I never commented on the ethicality of this subject, and this certainly isn't the appropriate venue to introduce and debate ecclesiastical concepts and concerns.

 

Alright heres a better analogy. Your friend buys a disc based game from walmart. You call him up and say you want that game but dont want to spend $60 on it. So he goes and makes an illegal copy of it from his computer and then gives it to you for free.
Thats essenstially what youd be doing. As you essentially have access to TWO copies (licenses) when there was only ONE purchased. Your stealing. And this feature of the console was NOT meant for what you are doing its meant for having access to YOUR games
on all YOUR HOME SYSTEMS.

Your scenario would be illegal, yes, but it's different from what we've been discussing because you purchase two licenses when you guy a game digitally, whereas it's only one license for disc games. There are some reasons as to why this is, but the key factor
is that you aren't artificially circumventing or removing any DRM from the game to make more copies of it than the system allows you to as you would be doing in that quote. Instead of illegally making a copy of the game, the disc version would have to come
with a digital download for you to give to your friend to make this a fully comparable analogy.

Nothing in the Code of Conduct, Terms of Use, Services Agreement, or the Usage Rules page that I posted place any restrictions on which console is your Home console. It's tacitly assumed on their part that most people would want to set their own console
as the Home Xbox in case their console is disconnected from Xbox Live or others within their household wish to access your games, which is why they recommend you set the feature onto your most frequently used console, but it's not a regulation. They anticipated
people doing this when they designed the feature, which is why they place the annual restriction on how many times you can change your Home Xbox. Moreover, as I've said before, people can legally belong to multiple "households" and they have no way of accurately
differentiating the numerous types of scenarios that this feature enables, which is part of the reason as to why the choose not to enforce it.
