Can't play until subscription payments are up to date

I've had this contract for almost two years now, around October of last year Microsoft forgot to bill me for xbox live and doubled up the flowing month. Then the month after that was ok, then they forgot to bill me and said I will not be billed twice for
it like they did last time. But they never charged me since December, and my xbox 360 is telling that I can't play until my subscription payments are up to date. Well I went on billing.microsoft.com to check and see what they've done and why I haven't been
being charged like normal. Well the contract transactions and contract all together isn't anywhere on there. So I have an unplayable xbox 360 because of a glitch in the billing system?

Xbox 360 is unusable.

My Xbox 360 says: "Sorry this console can't play until your subscription payments are up to date."

I bought this Xbox 360 brand new on ebay and never signed up for any subscription.

Is there anything I can do? My Xbox 360 is unusable.

My Xbox is telling me. Sorry, this console can't play until your subscription payments are up to date and Microsoft account not available . It won't even let me play a game but I'm still signed into Xbox live

for this issue I advise to contact Xbox Support. They are the best and only able to handle billing/payment issues like this one.
