    Cant gameshare


    So me and my friends tried to gameshare. The first time i gameshared was thanksgiving in 2014. Today july 25 2016 it said i couldnt gameshare. I logged into his account work fine. He did the same with my account it said i had to wait and only worked 3 times.
    I dont know what to do. Last time i gameshared was 2014. Help me thank you

    Yup as i stated in that thread that was referenced:

    The xbox "home" feature is only meant for sharing games accross xbox ones that YOU OWN. Not for gamesharing with friends.

    Doing so is considered marketplace theft and can get both you and your friend permanently banned. Also when you get permanently banned you forfeit all access to your digital games, dlc, remaining xbl gold
    membership,etc without refund.

    What are some specific examples of marketplace theft?

    Marketplace theft includes, but isn’t limited to:

    Getting, asking for, or using redemption codes illegitimately

    Transferring licenses to your console from an account that you didn’t create

    Using a system glitch or loophole for financial gain

    Using any sort of “shared” account to avoid having to pay for games or content

    Successfully redeeming or giving away a code and contacting customer support claiming the code didn’t work

    Attempting to defraud Microsoft or authorized agents

    Fraudulently transferring content licenses

    Sharing account credentials

    Asking to be added to someone’s third party subscription (such as Netflix, Hulu, etc.), in order to avoid restrictions or payment

    What sort of enforcement can I expect for marketplace theft?
    If you involve yourself with marketplace theft, your account can be permanently suspended. Especially egregious or repeated violations may lead to a device ban.

    You will have to contact support directly as they are the only ones that can reset that counter. Keep in mind since there is a 3 change per year limit they are not obligated to do it but definitely worth a try.

    YES. YOU DO lose access to everything when you get permanently banned.

    UPON RECEIVING A PERMANENT SUSPENSION, YOU FORFEIT ALL CONTENT LICENSES, GOLD MEMBERSHIP TIME, AND MICROSOFT ACCOUNT BALANCES ASSOCIATED WITH THE SUSPENDED ACCOUNT.

    And YES it is marketplace theft.

    Marketplace theft is getting content you DID NOT PAY FOR.

    When you gameshare you are either recieving or giving content to someone who DID NOT PAY FOR IT.

    So yes it would be considered gamesharing as its theft to the developers who made the game.

    You should really read up on the ToS/CoC because it sounds like you really dont understand it all that well. Doing so may save you from a ban in the future.

    The one who needs to read up is you, my friend. And "theft?" Really? That's a very strong word to be casually tossing around here. Whoever you let use your "Home" console/device license is up to you, and you aren't stealing anything. Nothing on that page

    First off, resorting to using capitalized letters doesn't lend credence to the points you're trying to justify in the slightest. In the future, I'd recommend avoiding doing so.

    This statement is very analogous to saying that breaking, losing, or otherwise rendering a physical game disc inoperable would cause you to lose access to your content. Yes, those scenarios are possible but not absolute. Those are two very big "ifs" you've
    listed. The overall takeaway is that that specific statement within the Code of Conduct is not wholly accurate in what it says because it suggests that users lose access to all of their licenses immediately upon a permanent suspension, which is clearly untrue
    more often than not. Hence, you shouldn't always take every statement you read on their pages as absolute gospel.

    A feature of the console is not a "shared account." You don't need to share account credentials or otherwise provide someone else access to your account to use the feature of the console. In fact, the option to enable this feature is not even listed under
    the "Account" section in settings, nor does your account even need to remain on the Xbox One console.

    So let me ask this:

    Your friend (or anyone else who you let use your "Home" console") doesn't need to pay the developers of the game in order to access the device license. That's one of the two primary functionalities of the feature to begin with. The definition of theft
    is: the action or crime of stealing. To steal is to: take (another person's property) without permission or legal right and without intending to return it.
    In this case, you are well within your legal right and have Microsoft's permission to let someone else use your "Home" Xbox One console's device license. It's expressly written into the license agreement when it states that, "Anyone can use your game
    on your Home console under your device license." They place no restriction on where your "Home" console is located. Going along with your logic, letting any other account aside from your own use your "Home" console or sharing a game disc's license would be
    theft, correct? You own the license to the game, and who you let access it is entirely discretionary.

    I would agree with this statement, but whether the "Home" console is or isn't meant to be used in certain ways is irrelevant unless it is expressly mentioned in the license agreement. Nowhere in any of their policies do they restrict which console you
    are allowed to designate as a the "Home" console, or where the "Home" console resides.

    It doesnt say your friends console. It says YOUR console.



    Nowhere on the Support page you linked does it expressly say that you are
    not allowed
    to set it to another console, or that you must do so to your console.

    In fact, the scenario of your "Home" console being designated as the friend's console is mentioned in the embedded video on the page you linked:


    The video makes no assertion that this a violation or that you are required or should switch it back to your own console.

    While it is true that Support is a different team from Enforcement, this by no means suggests that they lack accurate information regarding Microsoft's policies or invalidates them as a source of information regarding this inquiry. Many of the representatives
    with whom I spoke are trained not only to say that this is a feature of the console, but they will even assist you in setting it up properly with a friend. XBLPET is not going to penalize players when their own representatives say that this is fine, in at
    least some cases both players could be "game-sharing" without even being aware of it, and people can be legal residents of multiple "households." If they wished to penalize people for this, they would need to amend their legalese to make this expressly known
    to be forbidden.

    Major Nelson most likely will not reply to you about this. I just spoke with him in person a few hours ago about this and he said that as long as someone else isn't using your account you should be good.
