Can't buy Xbox One Backward Compatible 360 Games - Error

I do not have an Xbox Live Gold subscription anymore, and I believe its probably the issue. And my only payment method is Paypal. But I can't buy Backwards Compatible games on the console or through the website. On the console I hit the "See Price" and then
it gets stuck on "Working". On the website trying to buy a Backwards Compatible game, I get this error when i try to buy:

The Xbox One is not backwards compatible with Xbox 360 games so you can't play any 360 games on the Xbox One

Can't buy backwards compatible games on marketplace?

It's not gears 3, (for as far as i know gears 3 is not backwards compatible)

I can't download any backwards compatible game.

Is there another way then to log in on a xbox 360 console? like if i buy a physical disc of a backwards compatible game, would it work then? and would i be able to download 360 games after that.

I figured out why this error was occurring.

This error occurs if your Xbox Live subscription has expired and try to purchase a backwards compatible game. It would ba appreciated if you put a proper error message up there for customers in this situation - "Sorry, you must have an Xbox Live subscription
to purchase backwards compatible games" Or something....

The "Backwards Compatibility" only exists for games that they have told the XBox ONE to recognise as "Backwards Compatible".

Most of the games on the XBox 360 simply will not work on the XBox ONE.

Microsoft will claim the reason they can't make everything available at once is that they need a Publisher's permission to make the game Backwards Compatible.

But the real reason Backwards Compatibility exists is to lure XBox 360 owners who have been on the fence for a while into the false supposition that they will be able to play their 360 games on the ONE.

If you could do that... why not buy a ONE?

Yes, but only backwards compatable games. For example, you can't buy some games on the Xbox One, onky the 360.

If the DLC is for the Xbox One version of the game, then no, you can't use that DLC on the Xbox 360 version of the game.

For example, Assassins Creed IV Black Flag is a Backwards Compatible Xbox 360 game that works on the Xbox One. However, if you buy Xbox One DLC, then this will NOT work on the Xbox 360 version of the game.

But if you get the Xbox 360 DLC content for a Backwards Compatible game, the DLC will work on the emulated Xbox 360 on Xbox One.
