Can I have this as my gamerpic?

I'd rather get an answer from an Xbox representative before changing my gamerpic than receive a ban for an incredibly stupid reason. The picture in question is this:

The forums here follow the same terms of service as Xbox Live to all intents and purposes. You're just as likely to be banned, from the forums anyway, for posting it in here..

I can't see an issue with it personally, though it isn't at all pleasant to look at it is more likely to get reported by other gamers which may result in some kind of enforcement action.

You should use this general rule for anything you want to use on xbox live whether it be a gamerpic,gamertag your bio etc.
