How do I block a gamer whom I do not want to hear (they are not on my friends list)?

If you have a communications ban you can check enforcement.xbox.com however if is not listed there you may want to contact official support at support.xbox.com/contact-us if your ban has lifted and you still have been unable to chat for that long.

My guess would be someone put parental controls on the X Box; don't know why else it would block you after midnight or entirely off party chat.

No, they won't - according to the article linked below, when you block someone on your friends list, not only will it block communication from them, but it will also remove any friend attachment between you.

the best thing to do when someone calls you names or says other offensive things in a message or chat is to
report then mute and block the other person.

never reply to offensive messages as this could result in you getting an enforcement action and if you message a blocked user it will unblock them.
