So when Enforcement team take a look at a message Where you were sent something like [mod removed] or Stuff should the game you were on be taken into consideration? so if You were cursing At someone on a 18+ game should that be taken into consideration
and maybe Make The action be less Big but if its a game like minecraft should the action be bigger?

Unfortunately no. The games are rated for things like that, but Live is not. So everything on Live has to remain E for everyone.

From a moderation standpoint, it's also easier to make it more black and white than creating grey area. Otherwise, you have someone going "well I said the same thing as that person but why didn't they get a suspension" only because they are playing a different
type of game. You also just never know who you're playing with.

Even though a game may be rated for adults, not all adults want to hear that kind of language coming at them from other gamers.

Agree with Smwutches. I personally dont want to be cursed out on any game regardless of the rating. The ESRB didnt intend for the game ratings to govern things like player hostility.

Also keep in mind xbox enforcement doesn't punish players for "trash talk" when it's lighthearted-they do understand that some games can be competitive/heated.

If you scroll down on the community standards to "know the difference between trash talk and harassment" they have some good examples showing the difference.
