Bans for marketplace theft are usually permanent. and if the ban is older than 12months there is nothing that can be done.

he said that for console bans, mines a profile ban. I did get an email and it said I had been banned for marketplace theft , but i haven't commited a theft in the marketplace. and like i said earlier it wasnt even in the computers that i had been banned
when i called customer support, which makes no sense.

In general marketplace theft would be along the lines of buying an item from the xbox store then later going and applying for a chargeback with your bank or with paypal, The moment that happens microsoft are informed of this and your account is then suspended

You are incorrect,it can be done & is marketplace theft which will result in a ban.
