If a child hit another, the first child gets charged with ****, correct? But if the second child defends themselves, they don't get sanctioned. That is the laws eyes.

See, I get harassed by a guy who has violated the COC which I pointed out, so I defend myself and give him a bit back to show I'm not a pushover. But the "enforcement team investigate thoroughly their cases" well they don't.

See the second child doesn't get sanctioned, so why should I. I suppose EVERY judge would happen to agree with the story. But apparently if the first child was the first to report the incident, it can switch. -According to a Microsoft Agent.

So this is where it goes wrong. If the Enforcement Team actually did investigate, they would see this problem and surely recognise it. If I was to file a Lawsuit of Harassment against Enforcement Team (which I won't) then if I pointed this story out to them,
surely the judge would agree, right?

I don't understand how such a corrupt and stupid system of working sanctions both parties when all the second done was defend themselves. That's all I did, I end up with a longer suspension. However, the original Harasser and Violator of the COC gets off
lightly with a shorter one (I am guessing).

    Please help.

    :)

It is not recommended to "defend yourself" by adding more profanity to the conversation; this is how many people get comm-banned. Sending profane messages is considered a
Code of Conduct violation, and the Enforcement team will read over the conversation for violations.

The appropriate action for anybody sending hostile messages is to: mute, block, report, and move on.

As the Enforcement team does not post here, the forum cannot assist with your suspension. You will have to log on to
http://enforcement.xbox.com, check your Enforcement history, and submit a case review (if eligible).

Sorry, but no one here on the forums can address issues dealing with enforcement actions.

You will need to visit Xbox's enforcement page to find out any information about your current case.

Here are some links that might be useful for future reference.

Doesn't work like that. You agreed to follow the ToU/CoC of xbox live when you started your account & must follow those rules.

Any lawyer or Judge would point this out to you straight away

Doesn't matter who started it,if you retaliate in a way that violates the ToU/CoC then you risk being suspended.

The enforcement team do investigate both sides of what happened but you will not be informed if any action was taken against the other person.

The length of a suspension is down to the severity of the offence committed.

It's always best to just report & block someone harassing you on xbox live, don't retaliate.

  5. And what about the victim? They have to get repeatedly harassed for the opposer to get a permanent ban, and then they just make a new account and start over again. Meanwhile that victim can develop depression. The system is not efficient for people who repeatedly
abuse people. On Xbox 360, they used to IP ban people so that it was not worth harassing people but the system now is not at all good for players who get repeatedly harassed. The guy who I retaliated towards had his mate start messaging me and it wasn't abusive
but I had no way of asking him to stop or anything and I couldn't report it because he only messaged me once.

Anyone who repeatedly harasses other people or create new accounts to avoid bans/suspensions on other accounts will eventually have their console banned.

They have never ip banned people, besides it only takes a few minutes to change your ip address so it would be pointless anyway.

Block anyone you don't want to receive messages from, you can even set your comms to "friends only" if necessary.
