banned 11/22->12/8

so after a few days of sitting here unable to communicate with anyone on my xbox I feel like I should try for a writ of certiorari from the xbox support court. I was playing BF1 the other night and was doing well as I usually do with my gewehr 98
infantry and someone got angry that I killed him a few times in one match. I recieved a message that says in text, "your a ******g idiot" . I replied with " **** off " and deleted his message and went about my friendly casual gaming like normal.

Until i wake up a few days later and im banned from 11/22/2016 until 12/08/2016, I can log in but I cannot communicate in any way with any other xbox account.

Now my issue here is,

a) the fool who instigated this rediculous situation is probably not even repremanded because I dont immediately report people because I do have some dignity. however after I recieved my ban I instantly reported him as well. who knows tho.

b) I never sit in games on a mic and talk to random people, I ALWAYS am in a party with my close friends and thats literally it, if not in a party im not talking to anyone else. so now after I was verbally assaulted by some pissed off teenager and i replied
in turn ( sure its against ToS but obviously this is an exploit of your own system right under your nose) next time Im having a bad day i will - in perfectly politically correct language- instigate people to use one curse word and then report them all....great
oversight i really gotta hand it to you. (part of b is my anger from getting a too bad response on case review)

c) and now I have paid $15 a month for something that I have been disenfranchised from. and Im assuming you guys put it in your 8000 word legal document that you are the dictator and we are all at your mercy but come on and use critical thinking skills when
enforcing your rules instead of having a robot insta banning peoples paid services for common english language in the 21st century. so if you will not unban me than refund my money, instead of robbing me like everyone else on xbox. im grateful i havent been
stripped of my games that i paid 60$ for like i hear you guys do to all the perma banned accounts - which is disturbing.

d) if you really think it is best to uphold my suspension please use facts from the case and explain your response or I will just take this as microsoft telling me they dont want my $ next month or for a while .
