    Are these digital games a scam?


    I'm hoping i'm posting in the correct place, but i'm looking to buy a new xbox one and i'm looking on Kijiji, i'm seeing ads that have the digital games on them, like, one ad says that it has physical games and he has multiple digital games on the console,
    he noted that he'd have to keep his profile on that console. What i'm wondering is if this is a scam, or it could be a scam, or it's not, because I have my own account i'd be using and I want to play those games on mine without any problems or him doing something
    like changing password. If you need me to link some of them I will.

    Hello Siku,

    Are these games digital or on disc? Note that only digital games are eligible for Play Anywhere, so if these games are on disc you will not be able to play them on Windows 10.

    Hello DeathWolf,

    Buying and selling profiles is against the Xbox Live Terms of Use (ToU) and Code of Conduct (CoC), so these are definitely offers you will want to stay clear from. Engaging in this risks enforcement action like suspensions and bans.

    Buying physical games is, of course, fine, but buying an account to play the digital games that account owns is what breaks the ToU/CoC.

    Even if it weren't against the terms, doing this opens you up to the other person changing the password on that account or removing it from the console remotely, losing you access to games the other person claimed you now owned.

    Aw man, that sucks, oh well, thanks for the reply, I have one more little question though, with the ad that's offering the physical games and the digital games in one bundle, can I still buy it but never use the account for the games and i'll be fine? Like,
    would I be fine if I deleted the other account?

    It would be best to ask the other person to remove the account before they sell it to you. Even if you delete the account, its "Home Xbox" is still the console you want to buy, so all of its past purchases are still available for you to download - you could
    simply not download these, but if that other account ever made any new purchases, the game would automatically install on the Xbox.

    Alright, thanks, let's hope the guy is chill and won't screw me over, i'd rather not get my account banned, years and years of stuff on it, plus I know how difficult it is to talk to microsoft support about bans

    regardless of getting banned or not (which is a possibility), when you purchase games, they are licensed to your Gamertag for use on any console. they are also licensed to your Home Console for anyone who is using that console. however, the home console
    can be changed at any time. you would run into two possible issues. 1: you would be playing games licensed to the seller's gamertag, so you would have to use that gamertag to play, and only one of you can play on it at a time. assuming this person is selling
    multiple "pre-loaded" consoles, it's very likely someone else would be trying to use it as well. 2: you would be playing games licensed to the home console as set by the seller. at any time they could change which console was set to their home console, meaning
    you would lose all access to those games. either way it's against the terms of use, and generally not a good idea. anyone selling consoles containing digital games should be aware that they are not really transferable like that, and is quite likely using
    deceptive sales techniques. personally i would tell the seller that you plan to do a factory reset and use your own gamertag and are not interested in the digital games, as you have been informed that those would not be purchased legitimately by or licensed
    to you.

    i'm fairly certain that's how the licensing system work, but please excuse me if any part of that information is incorrect. it's basically a variation on the licensing system for the 360, except on the 360 each game could be purchased on a different console,
    giving it a different console license. but you could still have the gamertag who holds the license do a license transfer, which would remove all licenses to any other console and reassign them to one single console, meaning you would again lose access to
    the games.
