Are middle fingers allowed in Xbox profile pictures?

A good rule of thumb is, if you have to ask if it's allowed, you probably shouldn't use it.

If you profile picture breaks the terms of Service in some way, then, yes, you could get banned for it. The Middle Finger (assuming it is being used in the way that would be rude), whilst commonplace, is still a rude/Obscene gesture...as Xbox live is for Everyone, all content needs to be as such.

Someone posted on here yesterday where they'd been comm banned for 24 hours for an inappropriate GT picture and said picture was also removed
