Are Gamertags under Copyright/ trademark restrictions?

I was considering changing my gamertag to a very well known branded name, but it is trademarked/ copyrighted. Could there be legal action taken against me if I use such a name? What are the rights given to us as members of the Xbox live community and limitations
to which our Gamertags can be?

Why are you going on about Copyright infringement? This isn't about copyright, it's about a Trademark infringement, they are not the same thing.

Yes, the similarity of ideas effects the degree to which a similar Trademark can be considered infringing, but that isn't the same as copyright. It is not about copying someone, it's about using a similar representation of a similar product, which can cause
confusion.

No legal action should be taken upon you but if the company see's you as impersonation then they have the right to report the account officially and remove it off Xbox services.

I believe your incorrect. As there is a trademark and copyright sign on the product. It must adhere to copyright practices.
