App Store and Australian consumer law

Afternoon,

I asked @xboxaustralia on Twitter if the notice which appears on screen during a purchase from the Xbox One store (notice says something like "Refunds are not available"), contravenes Australian Federal Consumer law. Specifically, refer to:

Consumers' rights & obligations

Search for heading "Refunds and returns signs" which states:

"Signs that state ‘No refunds’ are unlawful."

The notice which appears in the Xbox one store when making a purchase appears to contravene Australian consumer law.

I am not a lawyer however this appears to be something that Microsoft may want to look into as there is a potential that Microsoft may be fined by the ACCC for this text.

Does someone from Xbox want to reply?

When will MS finally say that their Elite Controllers are made cheaply

IIf only US law was a strict as australia and nz law regarding consumer products. microsoft must be having fun loosing money for dishing out free replacement controllers for australian and nz customers who have had faulty controllers under what we enjoy
a longer warranty courtesy of our governments.

 

Can I get Refund for cod AW

Whether or not you can get a refund will depend on where you live. For example, in Australia, the Australian government recently took Valve to court over their no refunds policy because it is against Australian consumer law to refuse refunds on faulty products.

So, if you're in Australia, you might be in luck. Otherwise, your guess is as good as mine.
