Report the account and provide a description of what happened and enforcement will take action. Secure your account, you may want to look into two factor authentication.

In the meantime you can request a refund as well.

Under normal circumstances say You make a purchase and request a refund and that refund is approved the license for the game is taken away and you would not be able to play it.

In this circumstance the best people to answer that question for you would be xbox support which can be reached by going to support.xbox.com/contact-us

Enforcement will investigate it, and if they see the evidence he hacked into your account, im not 100% certain, but I do think they will give him some form of consequences.
