trying to get the banned lifted because at the time I didn't have the setting for child on my 360 and my nephew thought it was ok to curse and scream at people

No one here can do anything about console bans. You can find more information about them at https://support.xbox.com/en-US/help/family-online-safety/enforcement/xbox-live-device-bans but there's no way to have them reversed.
