A question about the Microsoft's Game Content Usage Rules

I apologize in advance if this post is in the wrong forum, I wasn't entirely sure where to ask a question like this.

I recently viewed a page about Microsoft's Game Content Usage Rules, (Game Content Usage Rules) which seem to ban the commercial use of content from games and making
money off of content from games with an exception of YouTube and Twitch programs which may allow you to earn revenue. Just to be sure, if I create a video on YouTube that uses content from an xbox game, (specifically a Halo-themed animated video with sounds
from various Halo games) does this mean that I am allowed to monetize the video?

    :)

Monetization of Halo Campaign on Youtube

    Hey internet,

I've been uploading some videos of myself playing the Halo campaign to youtube. Whenever I upload a video, it gets flagged for having third party music (the in game music itself is flagged) and disabled for monetization. As content like mine is explicitly
allowed under Microsoft's Game Content Usage Rules, how do I go about having youtube enable my videos for monetization?

    Microsoft Game Content Usage Rules

So, I was considering making a mod of Star Wars Empire at War that is halo related. I need models, of course, and so far I assumed that I needed to make them myself because of Microsoft's content rules. This is where I have my question. The rules state:

"You can't reverse engineer our games to access the assets or otherwise do things that the games don't normally permit in order to create your Items."

Does this statement also apply to Halo CE due to the fact that Halo Custom Edition was made directly for editing?

Thanks in advance to anyone who responds.

A question about the Microsoft's Game Content Usage Rules

This is a very grey area, and is entirely dependant of the company that makes the games themselves. If the content you are making is any of the following; commentary, search engines, criticism, parody, news
reporting, research, teaching, library archiving and scholarship, it could protected under the "Fair Use" laws of copyright laws. It may be a better idea to take a look at the content usage rules of Twitch and YouTube,
as there is where you'll be penalized for breaching any rules, not on Xbox Live.

Yes, as long as they're uploaded to Youtube / Twitch. Be sure to include somewhere in the video or in the description box the bolded notice in that article and you're good.

Question about Microsoft's Game Content Usage Rules

Hi DudeMoose! My name is Ricardo an independent advisor ready to help you with this situation!

Distribution of your Item in any form constitutes a grant by you of a royalty-free, non-exclusive, irrevocable, transferable, sub-licensable, worldwide, license to Microsoft and any of Microsoft's partners or users to use, modify and distribute that Item (and derivatives of that Item), and use your name if we choose to, for any purpose and without obligation to pay you anything, obtain your approval, or give you credit. And this license to Microsoft survives any termination or expiration of these Rules. This means that if you add to the game universe or expand on the story told in the game with "lost chapters" or back story or anything like that, distribution of your story or idea may appear in a future game without any compensation to you. (Sorry, but our lawyers tell us we need to do this in order to avoid frivolous lawsuits getting in the way of making more great games.) It also means we can put your Item on a Microsoft site or property if we want to.

    Hello,

Game content usage rules can be found here:

    https://www.xbox.com/en-us/developers/rules

If you share your Items with others, then you must include the following notice (or a prior version) about the Game Content. You can put it in a README file, or on the web page from where it's downloaded, or anywhere else that makes sense so long as
anyone who sees your Item will easily find this notice.

[Name of the Microsoft Game] © Microsoft Corporation. [The title of your Item] was created under Microsoft's "Game Content Usage Rules" using assets
from [Name of the Microsoft Game], and it is not endorsed by or affiliated with Microsoft.

These Rules apply to all games and Game Content published and owned by Microsoft Studios and for which Microsoft owns the copyright, trademark or other intellectual property.

If you have a question about whether these Rules apply to a particular game published by Microsoft Studios, email *** Die E-Mail-Adresse wurde aus Datenschutzgründen entfernt. ***.

    Hope this helps 😊

I understand that they don't want you messing with their IP's like that but so long as he doesn't sell it for a profit shouldn't he be fine? There are mods for all sorts of games that use skins from all sorts of media.
