360 titles as a digital purchase on Xbox One

Regarding backwards compatibility, as the disc is purely being used to check the license and the game itself will be downloaded, will we be able to purchase digital copies of 360 games we do not already own? e.g. I don't own a physical copy of Halo Reach
but would like to play it on my X1, could I buy it on the live store as a digital copy?

    :)

    Thanks for reaching out, Deadstroke469!

Game availability will vary by region, so not all games may be available for digital purchase where you are, but if you're able to purchase a backward compatible Xbox 360 title, you'll be able to play that title on both Xbox One and Xbox 360 consoles. There's
more information about that in the
    Backward Compatibility FAQ

    What's the point of Preload?

Preloading worked for me, far as I could tell, for Destiny. The game was pre-loaded onto my console from a previous digital purchase. When the 360 to Xbox One free upgrade deal was announced I cancelled the digital purchase via Xbox Support, but didn't delete
the pre-loaded content. On Destiny launch day I bought it on the 360's digital marketplace, then the Xbox One activated and installed the pre-download that I had sitting on the console.

A download isn't an installation. Unlike the 360, once you download a title it then has to be installed. Installation shouldn't take too long relative to the download time for 44GB on most consumer ISP connections.

From what I can understand, you're asking whether you can buy a game digitally from the Xbox Store? The answer is yes, if the said game is available for backward compatibility, then you will be able to purchase that game digitally from Xbox.com, after doing
so, it should appear on your Xbox One as 'Ready to Install'. Once you finish downloading, you should then be able to play that game without a disc, as you've bought it digitally from the Xbox Store.

Please note that the game you mentioned (Halo Reach) is not currently available for backward compatibility. The feature itself is not released to all Xbox One users either, it is set to be releasing later this year, and as of the moment, it is only available
for those who are partaking in the Preview Program.

The games with gold of the first xbox and xbox 360 are mine forever independent of the gold subscription.?

Original Xbox titles are much like Xbox One games and purchased through that store under backwards compatibility so the same rules as Xbox One titles apply and you will need to have an active Xbox Live Gold subscription to play those.

The Xbox 360 titles are different because of how that store was engineered and handled licensing, and the limitations of that store are why the "purchases" are permanent. Since the OG Xbox titles are purchased via the Xbox One digital storefront, they do
not have the same stipulations as the 360 titles.

Please note that I have not verified this myself, but a friend of mine tested this and was unable to play the backwards Xbox titles without an active Gold subscription, so if there is conflicting information, please feel free to correct me.

Pros and cons of having a game on disc vs. having a digital copy

Specific to Xbox One, Digital allows for play without a disc present. It prohibits resale. Games purchased digitally can often times be refunded with a call to Live Support. I did this for the Xbox One version of the Destiny Digital Guardian Edition after
the news came out about the buy on 360, get it on Xbox One for free.

Disc-based games must have the disc in the console to be played. They can be resold. Disc-based games routinely go on sale unlike Digital, though MS has been better about sales on digital titles as of late.

There is no "size" difference as both digital and disc titles deposit the same bits on to the Xbox One HDD. In fact, installed-from-disc titles can be converted to digital titles (and thus obviate the need for the disc) by simply buying the digital version
of an installed-from-disc title. No re-downloading is required.
