First off, I'm sure it's a general Xbox LIVE issue (See the status orientated around XBL content). I would suggest these following troubleshoot methods:

1. Check Xbox LIVE status to see if it's an issue on Microsoft's end.

2. Restart you router, reconnect & try again.

3. Close out any game - only if you're downloading from in-game.

Although a few are getting the issue, the likely cause is that it may be on Microsoft's end of things. Usually they're resolved within 24 hours, although they have been reported to last 2 - 4 hours.

The out-of-warranty charge will depend on what Xbox console you have, Keith.

If you would like, we can perform the last step which is resetting the console and removing everything. This will uninstall all of your games and apps but if the game is corrupted this will surely fix the issue.

If not, there is indeed a problem with the game because I have checked Xbox's live status page and there is no issue with the game, along with the known issue list reported on their end.
